Ministry of Industry and Mineral Resources: Decision 5005/1/1445 Designating the Depot Site for Sand Aggregate and Backfill Materials in Kharj Governorate as a Mining Depot for Mining Activities

after perusal of article 10 of the Mineral Investment Law issued by Royal Decree D/140 dated 19 Shawwal 1441 [11 June 2020], pursuant to the provisions of article 12 of the executive regulation of the law issued by Ministerial Decision 3293/1/1444 dated 5 Jumada Al-Thani 1444 [29 December 2022],

after obtaining the approvals of the relevant authorities regarding the designation of the depot site for sand aggregate and backfill materials located south of Hayir in Kharj Governorate of Riyadh Region,

and after perusal the offer of the Vice Minister for Mining Affairs,

and in pursuance of public interest,

hereby decides

First

A depot site for sand aggregate and backfill materials—south of Hayir—in Kharj Governorate of Riyadh Region with an area of 15.23 (square kilometers) is hereby designated as a mining depot site for mining activities, whose coordinates are set out below:

Second

Subject to the provisions of article 2 of the law, and without prejudice to the rights of any fixed private property by a legal document issued before the date of this decision, the site—the coordinates of which are set forth in paragraph First of this decision—must be preserved for its designated purpose and preserved from the infringements of others and not to be tampered with, altered, or owned, and it is not permitted to dispose of it in any way, including seizure.

Third

The competent entity in the ministry must follow up the site to ensure that it is not infringed upon.

Fourth

This decision must be communicated to those required to implement its provisions, and must be published on the electronic platforms of the ministry and the official gazette, and comes into force on the date of its issuance.

Royal Decree D/109 Approving the Amendment to the Law for Serving Domestic Pilgrims

With the help of Allah the Almighty

We, Salman bin Abdulaziz Al-Saud, the King of the Kingdom of Saudi Arabia,

based on article 70 of the Basic Law of Governance issued by Royal Order O/90 dated 27 Sha’ban 1412,

based on article 20 of the Law of the Council of Ministers issued by Royal Order O/13 dated 3 Rabi Al-Awwal 1414,

based on article 18 of the Law of the Shura Council issued by Royal Order O/91 dated 27 Sha’ban 1412,

after perusal of Shura Council Decision 323/44 dated 23 Dhu Al-Hijja 1444,

and after perusal of Council of Ministers Decision 482 dated 20 Jumada Al-Thani 1445,

have decreed as follows

First: The amendment to the Law of Service for Domestic Pilgrims issued by Royal Decree D/58 dated 28 Shawwal 1426 is hereby approved as follows:

1. Article 19(2) which stipulates: “If there is an objection to the decision of the committee relating to the collection of the value of these services or the consequences that arise from their non-payment that contravene the performance of Hajj rituals, the dispute shall be referred to the competent Sharia court” is hereby deleted.

2. Article 21 is hereby amended as follows: “The Ministry of Hajj and Umrah shall implement the decisions of the committee stipulated in article 19 of this law upon their ratification by the Minister of Hajj and Umrah, and those for whom a decision has been issued may file a grievance against it before the competent administrative court.”

3. Article 22(2) which stipulates: “Those for whom a punishment decision has been issued may file a grievance with the Board of Grievances within 60 days of being notified of the punishment decision” is hereby deleted.

4. Article 22(3) which stipulates: “Any objection to the decision of the committee relating to the collection of the value of unperformed services and the consequences arising from it that contravene the Hajj obligation shall be referred to the competent Sharia court” is hereby deleted.

5. Article 23 which stipulates: “The Ministry of Hajj and Umrah shall represent pilgrims before the competent Sharia courts in financial claims relating to violations of the provisions of this law, unless the pilgrim expresses to the ministry his desire to the contrary” is hereby deleted.

Second: His Royal Highness the Prime Minister, the ministers, and the heads of independent concerned authorities—each within their area of competence—shall implement this decree of Ours.

based on the powers entrusted to him by law,

based on article 13 (2) of the Government Tenders and Procurement Law issued by Royal Decree D/128 dated 13 Dhu Al-Qa’dah 1440 [July 16 2019], which stipulates that “the minister shall approve the forms of tender documents, pre-qualification documents, forms of contracts, forms of evaluating the performance of contractors, and any other document required by the nature of the works or purchases.”

hereby decides

First

The Contract Form “Operation and Maintenance of Administrative Buildings—Contracting Based on Performance” is hereby approved in accordance with the form attached to this decision.

Second

The Booklet Form of Conditions, Specifications and Annexes “Operation and Maintenance of Administrative Buildings—Contracting Based on Performance” is hereby approved in accordance with the form attached to this decision.

Third

This decision must be communicated to those required to implement it and act on it, starting from the date of its publication in the official gazette.

and after perusal of Council of Ministers Decision 464 dated 13 Jumada Al-Thani 1445 [26 December 2023],

have decreed as follows

First

Article 14 of the Law of Private Health Institutions issued by Royal Decree D/40 dated 3 Dhu Al-Qa’dah 1423 [6 January 2003], is hereby amended to read as follows:

It is required for the licence of any of the general polyclinics and the specialised polyclinics to have—at least—a consultant doctor or a deputy doctor as specified by the regulation in each of the licensed main specialties, and at least one nurse shall be assigned to each clinic.

Second

His Royal Highness the Prime Minister, the ministers, and the heads of independent concerned authorities—each within their area of competence—shall implement this decree of Ours.

Saudi Authority for Intellectual Property: Decision 45044 Approving the Amendment of the Licensing Rules for Providing Intellectual Property Services

The Board of Directors of the Saudi Authority for Intellectual Property, based on the powers and competences entrusted to it by law and on the provisions of article 3(11) of the System of the Saudi Authority for Intellectual Property, approved by Council of Ministers Decision 496 dated 14 Ramadan 1439 [29 May 2018], as amended by Council of Ministers Decision 621 dated 20 Shawwal 1442 [1 June 2021], stipulates that the authority, in order to achieve its objectives, shall licence activities related to the field of work of the authority,

based on article 5 of the regulation referred to above,

and after perusal of the Board of Directors Executive Sub-Committee Recommendation 03/04/2023 dated 19 Jumada Al-Awwal 1445 [22 September 2024],

and in pursuance of public interest,

hereby decides

First

The Amendment of the Licensing Rules for Providing Intellectual Property Services in accordance with the form of the proposal is hereby approved.

Second

The chief executive officer of the authority is hereby tasked with completing the necessary procedures.

Third

The amended licensing rules must be published in the official gazette, and come into force from the date of its publication.
