Royal Decree D/86 Approving the Extension of the Authority of the Minister of Finance to Exempt From the Provisions of the Government Tenders and Procurement Law

With the help of Allah the Almighty

We, Salman bin Abdulaziz Al-Saud,

the King of the Kingdom of Saudi Arabia,

based on article 70 of the Basic Law of Governance issued by Royal Order O/90 dated 27 Sha’ban 1412 [1 March 1992],

based on article 20 of the Law of the Council of Ministers issued by Royal Order O/13 dated 3 Rabi Al-Awwal 1414 [21 August 1993],

based on article 18 of the Law of the Shura Council issued by Royal Order O/91 dated 27 Sha’ban 1412 [1 March 1992],

after perusal of Shura Council Decision 196/19 dated 4 Sha’ban 1446 [3 February 2025],

and after perusal of Council of Ministers Decision 306 dated 29 Rabi Al-Thani 1447 [21 October 2025],

have decreed as follows

First

The extension of the authority of the Minister of Finance to exempt from the provisions of the Government Tenders and Procurement Law issued by Royal Decree D/128 dated 13 Dhu Al-Qa’dah 1440 [16 July 2019], which cannot be applied when applying the rules of income participation, for a period not exceeding three years, starting from the date of expiry of the period specified in clause Second of Royal Decree D/33 dated 13 Rabi Al-Thani 1443 [18 November 2021] is hereby approved, provided that the Ministry of Finance coordinates with the relevant entities to study the appropriate alternatives to the request for exemption from the law before the expiry of this extension.

Second

The Prime Minister, the ministers, and the heads of independent concerned agencies—each within their area of mandates—shall implement this decree of Ours.

Saudi Central Bank: Decision 179/OFC Approving Amendments to the Executive Regulation of the Law on the Oversight of Financing Companies

The Governor of the Saudi Central Bank,

based on the powers provided in article 4 of the Law of the Saudi Central Bank issued by Royal Decree D/36 dated 11 Rabi Al-Thani 1442 [26 November 2020], which stipulates the mandate of the central bank to “issue regulations and instructions relating to financial institutions and their activities”,

pursuant to article 39 of the Law on the Oversight of Financing Companies issued by Royal Decree D/51 dated 13 Sha’ban 1433 [3 July 2012], which stipulates that “the Governor shall issue the regulation within 90 days from the date of issuance of the law, and it comes into force upon the entry into force of the law”,

and after perusal of the Governor of the Central Bank of Saudi Arabia Decision 2/OFC dated 14 Rabi Al-Thani 1434 [24 February 2013] issuing the Executive Regulation of the Law on the Oversight of Financing Companies, Decision 80/OFC dated 16 Muharram 1441 [15 September 2019] issuing the Rules for the Practice of Micro-finance Activities, and Decision 82/OFC dated 13 Rabi Al-Thani 1441 [10 December 2019] issuing the Rules for the Regulation of Micro Consumer Financing Companies,

hereby decides

First

The amendments to the Executive Regulation of the Law on the Oversight of Financing Companies are hereby approved in the form attached.

Second

The Rules for the Practice of Micro-finance Activity, issued by Decision 80/OFC dated 16 Muharram 1441 [15 September 2019], are hereby repealed.

Third

The Rules for the Regulation of Micro Consumer Financing Companies, issued by Decision 82/OFC dated 13 Rabi Al-Thani 1441 [10 December 2019], are hereby repealed.

Fourth

This decision repeals all decisions in conflict with it.

Fifth

This decision comes into force on the date of its publication. Microfinance companies are granted a period of 90 days from the date of its publication to rectify their status in accordance with the provisions of this decision. This decision must be communicated to those who are required to adopt and implement it.

The Minister of Interior,

based on the powers entrusted to him,

after perusal of the Traffic Law issued by Royal Decree D/85 dated 26 Shawwal 1428 [7 November 2007] and its amendments,

and after perusal of the Executive Regulation of the Traffic Law issued by Ministerial Decision 2249 dated 10 Rabi Al-Awwal 1441 [7 November 2019] and its amendments,

and in pursuance of public interest,

hereby decides

First

Paragraph 21(1)(4) of the Executive Regulation of the Traffic Law is hereby deleted.

Second

This decision must be communicated to the relevant entities, to implement it, each within the area of their mandate.

Third

This decision comes into force on the date of its publication in the official gazette.

after perusal of Royal Order O/4 dated 20 Muharram 1414 [10 July 1993], Royal Order O/14 dated 3 Rabi Al-Awwal 1414 [20 August 1993], and Royal Order O/82 and Royal Order O/83 dated 29 Rabi Al-Awwal 1446 [21 September 2025],

and based on the matters presented to us by His Royal Highness the Crown Prince,

We hereby order the following

First

The Honorable Sheikh Dr Salih bin Fawzan bin Abdullah Al-Fawzan is hereby appointed Grand Mufti of the Kingdom of Saudi Arabia, Chairman of the Council of Senior Scholars, and General President of the General Presidency of Scholarly Research and Ifta, with the rank of Minister.

Second

This order of Ours must be communicated to the competent entities for adoption and implementation.

after perusal of the Government Tenders and Procurement Law issued by Royal Decree D/128 dated 13 Dhu Al-Qa’dah 1440 [16 July 2019],

after perusal of Royal Decree D/33 dated 13 Rabi Al-Thani 1443 [18 November 2021],

after considering Shura Council Decision 196/19 dated 4 Sha’ban 1446 [3 February 2025],

and after perusal of General Committee of the Council of Ministers Recommendation 2997 dated 19 Rabi Al-Awwal 1447 [11 September 2025],

hereby decides

The extension of the authority of the Minister of Finance to exempt from the provisions of the Government Tenders and Procurement Law issued by Royal Decree D/128 dated 13 Dhu Al-Qa’dah 1440 [16 July 2019], which cannot be applied when applying the rules of income participation, for a period not exceeding three years, starting from the date of expiry of the period specified in clause Second of Royal Decree D/33 dated 13 Rabi Al-Thani 1443 [18 November 2021] is hereby approved, provided that the Ministry of Finance coordinates with the relevant entities to study the appropriate alternatives to the request for exemption from the law before the expiry of this extension.

The undersecretary of the ministry for agriculture,

based on the powers entrusted to him by law,

based on article 36 of the Agriculture Law issued by Royal Decree D/64 dated 10 Sha’ban 1442 [23 March 2021],

Ministerial Decision 14967/1/1444 dated 15 Muharram 1444 [13 August 2022] approving the Executive Regulation of the Agriculture Law,

and based on the approval of the Minister in response to Letter 26555/2384/1444 dated 11 Rabi Al-Awwal 1444 [7 October 2022], authorizing the undersecretary of the ministry for agriculture with the power to issue technical manuals relating to the Executive Regulation of the Agriculture Law, their conditions and controls, and amend them based on article 35 of the Agriculture Law,

and in pursuance of the interest of work,

hereby decides

First

The Manual for Regulating the Accreditation of Nurseries and Seedlings is hereby adopted in the form attached.

Second

This decision comes into force on the date of its publication, it must be communicated to those who are required to implement it and act by virtue of it, and it repeals all previous decisions in conflict with it.
