Council of Ministers: Decision 255 Amendment of the Anti-Bribery Law

The Council of Ministers,

after perusal of Royal Court File 18755 dated 23 Rabi Al-Awwal 1443 [29 October 2021], which includes Chairman of the Oversight and Anti-Corruption Authority Letter 5307/105 dated 11 Jumada Al-Awwal 1441 [6 January 2020], regarding the amendment of the Anti-Bribery Law,

after perusal of the Anti-Bribery Law issued by Royal Decree D/36 dated 29 Dhu Al-Hijja 1412 [30 June 1992] and its amendments,

after perusal of Bureau of Experts at the Council of Ministers Minutes 544 dated 1 Ramadan 1442 [13 April 2021],

after perusal of Secretariat of the Political and Security Affairs Council Telegram 3676 dated 4 Rabi Al-Awwal 1443 [10 October 2021],

after considering Shura Council Decision 22/5 dated 20 Rabi Al-Awwal 1443 [26 October 2021],

and after perusal of General Committee of the Council of Ministers Recommendation 3083 dated 11 Rabi Al-Thani 1443 [16 November 2021],

hereby decides

The Anti-Bribery Law issued by Royal Decree D/36 dated 29 Dhu Al-Hijja 1412 [30 June 1992] is hereby amended as follows:

1․ The phrase “every person” hereby replaces the phrase “every public officer” mentioned in article 5.

2․ Article 8(7) is hereby amended to read as follows:

Foreign public officers and officers of international institutions and organisations in relation to the conduct of international business.

3. Article 15 is hereby amended to read as follows:

Whoever is convicted of the crime of bribery must be sentenced to the confiscation of the property, advantage, or benefit that is the subject of the crime whenever possible, or the confiscation of its value, as the case may be, and the confiscation of any proceeds resulting from that property, advantage, or benefit.

and after perusal of Council of Ministers Decision 72 dated 27 Muharram 1442 [15 September 2020],

after perusal of Bureau of Experts at the Council of Ministers Memo 674 dated 26 Rabi Al-Thani 1442 [11 December 2020], Memo 1095 dated 3 Rajab 1442 [15 February 2021], Memo 1694 dated 24 Ramadan 1442 [6 May 2021], Memo 41 dated 4 Muharram 1443 [12 August 2021], Memo 241 dated 24 Muharram 1443 [1 September 2021], and Memo 302 dated 6 Safar 1443 [13 September 2021],

after perusal of Council of Economic and Development Affairs Minutes 16/43/M dated 5 Muharram 1443 [13 August 2021] and Recommendation 3-6/43/D dated 2 Safar 1443 [9 September 2021],

and after perusal of General Committee of the Council of Ministers Recommendation 3372 dated 20 Rabi Al-Thani 1443 [25 November 2021],

hereby decides

First

The replacement of the phrase “Saudi Red Sea Authority” with the phrase “Red Sea Tourism Authority” in clause First of Council of Ministers Decision 72 dated 27 Muharram 1442 [15 September 2020] is hereby approved.

Second

The Organizational Arrangements of the Saudi Red Sea Authority is hereby approved in the form attached.

Council of Ministers: Decision 250 Approving the establishment of the General Authority for the Conservation of Coral Reefs and Turtles in the Red Sea

The Council of Ministers,

after perusal of Royal Court File 23893 dated 30 Rabi Al-Thani 1442 [23 November 2020], which includes the Minister of Environment, Water, and Agriculture Telegram 245429/1/1442 dated 25 Rabi Al-Thani 1442 [24 November 2020], regarding the draft Organizational Arrangements of the Public Institution for the Conservation of Coral Reefs and Turtles in the Red Sea,

after perusal of the mentioned draft organizational arrangements,

after perusal of Bureau of Experts at the Council of Ministers Minutes 570 dated 17 Ramadan 1442 [29 April 2021] and Memo 1971 dated 13 Dhu Al-Qa’dah 1442 [23 June 2021],

after perusal of Council of Economic and Development Affairs Recommendation 6-38/42/I dated 24 Ramadan 1442 [6 May 2021]

and after perusal of General Committee of the Council of Ministers Recommendation 8423 dated 27 Dhu Al-Qa’dah 1442 [7 July 2021]

hereby decides

First

The establishment of the Public Institution for the Conservation of Coral Reefs and Turtles in the Red Sea is hereby approved, in accordance with its attached organizational arrangements.

Second

The Public Institution for the Conservation of Coral Reefs and Turtles in the Red Sea shall, within a period not exceeding 12 months from the date of approval of clause First of this decision, undertake the following:

1․ Prepare a draft system for the institution, in light of the organizational arrangements—stipulated in clause First of this decision—and the matters that may appear to it in this regard, and submit it, in preparation for completing the necessary legal procedures in this regard.

2․ Review the laws, orders, decrees, decisions, and instructions that have been affected by the provisions of the organizational arrangements—stipulated in clause First of this decision—in coordination with whomever it deems appropriate, propose their amendment in accordance with those arrangements, and report on matters that require the completion of legal procedures in their regard.

Third

Entities that exercise mandates related to the conservation of coral reefs and turtles in the Red Sea—for which the Public Institution for the Conservation of Coral Reefs and Turtles in the Red Sea is competent in accordance with the organizational arrangements stipulated in clause First of this decision—shall continue to exercise their mandates, in coordination with the institution, until the institution undertakes those mandates. Its board of directors may review the work of those entities—related to the mandates of the institution—determine what the institution will undertake from them, and report on matters that require action in their regard.

Ministry of Environment, Water, and Agriculture: Decision 1442/1/514035 Approving the implementation of the conditions and regulations for importing fresh vegetables and fruits into the Kingdom

The Minister of Environment, Water, and Agriculture,

based on the powers entrusted to him by law,

with reference to article 15(1) of the Agricultural Quarantine Law of the States of the Cooperation Council for the Arab States of the Gulf, which stipulates that “No shipment must be allowed to enter the state except under an import license and a phytosanitary certificate issued by the competent authority in the exporting country”, and the provisions of article 12 of the Executive Regulation of the Agricultural Quarantine Law stating that “The entity wishing to import plants, plant products, or materials subject to phytosanitary regulations that require an import permit shall submit its application to the competent authority”, based on the international standards of the Commission on Phytosanitary Measures (CPM), which allow countries to set requirements on imported goods, and in pursuance of public interest.

hereby decides

First

The application of The Conditions and Controls for the Import of Fresh Vegetables and Fruits to the Kingdom of Saudi Arabia is hereby approved in the form attached to the decision.

Second

The competent authority shall coordinate with the relevant entities in this regard.

Third

This decision comes into force on the date of publication of these conditions and controls in the official gazette.

Fourth

This decision repeals all previous decisions in conflict with it, and it must be communicated to those who are required to implement it.

Royal Decree D/34 Approving a General Cooperation Agreement between the Kingdom and the Republic of Rwanda

We, Salman bin Abdulaziz Al-Saud,

the King of the Kingdom of Saudi Arabia,

based on article 70 of the Basic Law of Governance issued by Royal Order O/90 dated 27 Sha’ban 1412 [1 March 1992],

based on article 20 of the Law of the Council of Ministers issued by Royal Order O/13 dated 3 Rabi Al-Awwal 1414 [21 August 1993],

based on article 18 of the Law of the Shura Council issued by Royal Order O/91 dated 27 Sha’ban 1412 [1 March 1992],

after perusal of Shura Council Decision 9/2 dated 6 Rabi Al-Awwal 1443 [12 October 2021],

and after perusal of Council of Ministers Decision 224 dated 18 Rabi Al-Thani 1443 [23 November 2021],

have decreed as follows

First

The General Agreement on Cooperation Between the Government of the Kingdom of Saudi Arabia and the Government of the Republic of Rwanda signed in the city of Kigali on 27 Shawwal 1442, corresponding to 8 June 2021, is hereby approved in the form attached.

Second

His Royal Highness the Prime Minister, the ministers, and the heads of independent concerned agencies—each within their area of mandate—shall implement this decree of Ours.
