Royal Decree D/14 Approving The Memorandum of Understanding Between Public Prosecution in the Kingdom and the Ministry of Justice in Algeria

With the help of Allah the Almighty

We, Salman bin Abdulaziz Al-Saud,

the King of the Kingdom of Saudi Arabia,

based on article 70 of the Basic Law of Governance issued by Royal Order O/90 dated 27 Sha’ban 1412 [2 March 1992],

based on article 20 of the Law of the Council of Ministers issued by Royal Order O/13 dated 3 Rabi Al-Awwal 1414 [21 August 1993],

based on article 18 of the Law of the Shura Council issued by Royal Order O/91 dated 27 Sha’ban 1412 [2 March 1992],

after considering Shura Council Decision 235/38 dated 2 Dhu Al-Qa’dah 1443 [2 June 2022],

and after perusal of Council of Ministers Decision 52 dated 18 Muharram 1444 [16 August 2022],

have decreed as follows

First

The Memorandum of Understanding between the Public Prosecution in the Kingdom of Saudi Arabia and the Ministry of Justice of the People’s Democratic Republic of Algeria signed in the city of Riyadh on 3 Sha’ban 1443, corresponding to 6 March 2022, is hereby approved in the form attached.

Second

His Royal Highness the Deputy Prime Minister, the ministers, and the heads of independent concerned authorities—each within their area of competence—shall implement this decree of Ours.

The Memorandum of Understanding Between The Public Prosecution in the Kingdom and the Ministry of Justice in Algeria

The Public Prosecution of the Kingdom of Saudi Arabia and the Ministry of Justice of the People’s Democratic Republic of Algeria hereinafter referred to as the “Parties”.

In order to strengthen and develop the existing relations of friendship and cooperation between them, and from the point of view of achieving mutual benefit, within the limits of their respective powers, and desiring to combat crime in all its forms, they agreed on the following:

Article 1

This memorandum aims to develop cooperation between the two parties in their field of competence in combating crime, especially the organized crimes, terrorism, money laundering, crimes related to drugs, crimes related to information systems, and crimes related to money circulation.

Article 2

The cooperation referred to in article 1 in particular includes the following:

1. Exchanging information, visits, and experiences in fields related to the activities and work of the parties.

2. Conducting research on fundamental issues related to the common interests of the parties.

3. Holding joint working sessions and holding meetings between specialists.

4. Holding scientific and theoretical events on issues related to the work of the parties.

5. Requesting research, inquiring, collecting evidence, investigating, and implementing legal assistance in accordance with the provisions of the relevant agreements signed by both countries.

6. Any other field agreed upon by the parties.

Article 3

Each party shall provide the other party, within the framework of this memorandum, with the necessary assistance, in accordance with the legislation and regulations in force in its country.

Article 4

Within the framework of the application of the provisions of this memorandum, each party appoints a coordinator for this.

Article 5

Each party may, if necessary, request information, and one can send information to the other party if it considers that its availability could assist it in initiating or proceeding with the investigation.

Article 6

The parties shall maintain the confidentiality of the information exchanged between them within the framework of this memorandum, and neither of them may transfer it to a third party except after the written consent of the party that submitted it.

Article 7

1. The application of this memorandum must be in accordance with the laws and regulations in force in both countries, and in accordance with the limits and capabilities available to both parties.

2. Each party shall bear, in accordance with its available capabilities, the costs related to the implementation of the provisions of this memorandum.

Article 8

Any dispute arising between the parties regarding the interpretation or application of this memorandum must be settled amicably between them through discussions.

Article 9

1. This memorandum enters into force from the date of the last mutual notice between the parties, through diplomatic channels, confirming the completion of the necessary procedures for its approval.

2. This memorandum remains valid for a period of four years from its entry into force, and it is automatically renewed for a similar period or periods, unless one of the parties expresses, in writing, through diplomatic channels, its desire to terminate or not renew it, at least three months before its expiry date.

3. It is permitted to amend the provisions of this memorandum with the written consent of the parties and in accordance with the necessary procedures for this in the two countries.

4. The termination or expiry of this memorandum does not prejudice the programs or works that have been under it and have not yet been completed, unless the parties agree otherwise.

This memorandum is made and signed in the city of Riyadh in the Kingdom of Saudi Arabia on 3 Sha’ban 1443, corresponding to 6 March 2022, in two original copies in the Arabic language, each of which is equally authentic.

after perusal of the aforementioned draft agreements,

after perusal of Council of Ministers Decisions 138 dated 3 Jumada Al-Awwal 1433 [8 December 2021] and 161 dated 28 Rabi Al-Awwal 1436 [19 March 2015],

after perusal of the Bureau of Experts at the Council of Ministers Memorandum 2065 dated 10 Ramadan 1443 [12 April 2022],

after considering Shura Council Decision 212/36 dated 29 Sha’ban 1443 [31 May 2022],

and after perusal of the General Committee of the Council of Ministers Recommendation 10498 dated 30 Dhu Al-Qa’dah 1443 [30 June 2022],

hereby decides

First

The Agreement on Recruitment of Workers between the Government of the Kingdom of Saudi Arabia and the Government of the Republic of Burundi signed in the city of Riyadh on 26 Safar 1443, corresponding to 3 October 2021, is hereby approved in the form attached.

Second

The Agreement on Domestic Workers Recruitment between the Government of the Kingdom of Saudi Arabia and the Government of the Republic of Burundi signed in the city of Riyadh on 26 Safar 1443, corresponding to 3 October 2021, is hereby approved in the form attached.

A draft royal decree has been prepared in the form attached.

The Governor of the Zakat, Tax, and Customs Authority,

based on the powers entrusted to him by law,

after perusal of the Electronic Invoicing Regulation issued by the board of directors of the authority Decision 2-6-20 dated 4 Rabi Al-Thani 1442 [18 November 2020], based on article 6(a) of the attached regulation,

and after perusal of Administrative Decision 19821 dated 15 Shawwal 1442 [27 May 2021], and its amendments, which approved the controls, requirements, technical specifications, and procedural rules necessary to implement the provisions of the Electronic Invoicing Regulation,

hereby decides

First

All persons subject to the Electronic Invoicing Regulation whose annual revenues subject to value-added tax for the year 2021 or the year 2022 exceed 50,000,000 (fifty million) Riyals must commit to linking their electronic invoicing systems, sending electronic invoices and electronic notices, and sharing their data with the authority—the seventh stage of linking electronic invoicing systems with the systems of the authority—as of 1 February 2024 and until the latest of 31 May 2024.

Second

The authority shall notify persons who meet the criteria stipulated in this decision using the means of communication approved by the authority within the specified time period.

Third

This decision must be communicated to those required to implement it, and comes into force on the date of its publication on the official gazette.
