We, Salman bin Abdulaziz Al-Saud,

the King of the Kingdom of Saudi Arabia,

based on article 70 of the Basic Law of Governance issued by Royal Order O/90 dated 27 Sha’ban 1412 [1 March 1992],

based on article 20 of the Law of the Council of Ministers issued by Royal Order O/13 dated 3 Rabi Al-Awwal 1414 [21 August 1993],

based on article 18 of the Law of the Shura Council issued by Royal Order O/91 dated 27 Sha’ban 1412 [1 March 1992],

after perusal of Shura Council Decision 9/2 dated 6 Rabi Al-Awwal 1443 [12 October 2021],

and after perusal of Council of Ministers Decision 224 dated 18 Rabi Al-Thani 1443 [23 November 2021],

have decreed as follows

First

The General Agreement on Cooperation Between the Government of the Kingdom of Saudi Arabia and the Government of the Republic of Rwanda signed in the city of Kigali on 27 Shawwal 1442, corresponding to 8 June 2021, is hereby approved in the form attached.

Second

His Royal Highness the Prime Minister, the ministers, and the heads of independent concerned agencies—each within their area of mandate—shall implement this decree of Ours.

hereby decides

The General Agreement on Cooperation Between the Government of the Kingdom of Saudi Arabia and the Government of the Republic of Rwanda signed in the city of Kigali on 27 Shawwal 1442, corresponding to 8 June 2021, is hereby approved in the form attached.

after perusal of Royal Court File 48293 dated 24 Sha’ban 1442 [6 April 2021], which includes the Minister of Finance, Chairman of the Board of Directors of the General Organization for Social Insurance Letter 8802 dated 22 Sha’ban 1442 [4 April 2021], regarding the minutes of the committee formed based on Clause Fourth of Council of Ministers Decision 769 dated 30 Dhu Al-Qa’dah 1441 [21 July 2020],

after perusal of the Civil Pension Law issued by Royal Decree D/41 dated 29 Rajab 1393 [27 August 1973] and its amendments,

after perusal of the Social Insurance Law issued by Royal Decree D/33 dated 3 Ramadan 1421 [29 November 2000] and its amendments,

after perusal of the Law on the Exchange of Benefits Between the Civil and Military Pension Laws and the Social Insurance Law issued by Royal Decree D/53 dated 23 Rajab 1424 [20 September 2003] and its amendments,

after perusal of Council of Ministers Decision 769 dated 30 Dhu Al-Qa’dah 1441 [21 July 2020],

after perusal of Bureau of Experts at the Council of Ministers Memo 2085 dated 20 Dhu Al-Qa’dah 1442 [30 June 2021] and Memo 513 dated 28 Safar 1443 [5 October 2021],

after perusal of Council of Economic and Development Affairs Recommendation 28-48/42/I dated 25 Dhu Al-Hijja 1442 [15 July 2021],

and after perusal of General Committee of the Council of Ministers Recommendation 2483 dated 25 Rabi Al-Awwal 1443 [31 October 2021],

hereby decides

First

The Saudi Authority for Intellectual Property shall pay the additional financial costs resulting from the Civil Pension Law due to the application of the procedures mentioned in Council of Ministers Decision 769 dated 30 Dhu Al-Qa’dah 1441 [21 July 2020], which amount to 4,316,090 (four million three hundred and sixteen thousand and ninety) Riyal.

Second

The Saudi Authority for Intellectual Property shall pay the additional financial costs resulting from the Social Insurance Law due to the application of the procedures mentioned in Council of Ministers Decision 769 dated 30 Dhu Al-Qa’dah 1441 [21 July 2020], which amount to 26,379,997 (twenty-six million three hundred and seventy-nine thousand nine hundred and ninety-seven) Riyal.

Third

The additional financial costs—referred to in clauses First and Second of this decision—must be paid within 12 months from the date of 31 December 2020, on the basis of which the actuarial valuation was prepared, in accordance with the established legal procedures.

based on the powers entrusted to it by law,

based on article 4(1)(a) and article 22(2) of the Electricity Law issued by Royal Decree D/44 dated 16 Jumada Al-Awwal 1442 [31 December 2020].

based on article 5 of the statute of the authority issued by Council of Ministers Decision 263 dated 14 Jumada Al-Awwal 1442 [29 December 2020],

after perusal of Royal Order 41156 dated 23 Rajab 1440 [30 March 2019] and Royal Order 48790 dated 24 Ramadan 1439 [8 June 2018].

after perusal of the Executive Regulation of the Electricity Law regarding the functions of the authority approved by the board of directors of the authority Decision 27/11/3 dated 15 Rabi Al-Thani 1427 [13 May 2006].

after perusal of Circular Memo 43/02 presented to the board, which includes the request for the approval of the board to adopt the Executive Regulation of the Electricity Law regarding the functions of the authority in accordance with the attached form,

and after perusal of the minutes of the review meeting 43/02 dated 13 Rabi Al-Thani 1443, corresponding to 18 November 2021, and in pursuance of public interest,

hereby decides

First

The Executive Regulation of the Electricity Law regarding the functions of the authority is hereby approved in the form attached to this decision.

Second

The application of the provisions of the regulation referred to in clause First of this decision does not prejudice the mandates of the Ministerial Committee for the Restructuring of the Electricity Sector and the Saudi Electricity Company formed by Royal Order 41156 dated 23 Rajab 1440 [30 March 2019] in accordance with what is stated in Royal Decree D/44 dated 16 Jumada Al-Awwal 1442 [31 December 2020] issued in regard to the Electricity Law.

Third

The application of the provisions of the regulation referred to in clause First of this decision does not prejudice the mandates of the Executive Committee for the Governance of the Amendment of the Prices of Energy and Water Products formed by Royal Order 48790 dated 24 Ramadan 1439 [8 June 2018] in accordance with what is stated in Royal Decree D/44 dated 16 Jumada Al-Awwal 1442 [31 December 2020] issued in regard to the Electricity Law.

Fourth

This decision must be published in the official gazette and on the website of the authority.

Fifth

This decision must be communicated to those who are required to implement it.

First

The period of nine months mentioned in clause Second(3) of Royal Decree D/165 dated 19 Dhu Al-Qa’dah 1441 [10 July 2020] is hereby extended for an additional nine months.

Second

His Royal Highness the Deputy Prime Minister, the ministers, and the heads of independent concerned authorities—each within their area of mandate—shall implement this decree of Ours.

based on article 18 of the Law of the Shura Council issued by Royal Order O/91 dated 27 Sha’ban 1412 [1 March 1992],

after perusal of Shura Council Decision 1/1 dated 5 Rabi Al-Awwal 1443 [11 October 2021],

and after perusal of Council of Ministers Decision 215 dated 11 Rabi Al-Thani 1443 [16 November 2021],

have decreed as follows

First

Government agencies are hereby allowed to use income sharing as a contracting method for securing goods and services, and the Minister of Finance is hereby granted the authority to approve the rules of income sharing.

Second

The Minister of Finance is hereby granted the authority to exempt from the provisions of the Government Tenders and Procurement Law issued by Royal Decree D/128 dated 13 Dhu Al-Qa’dah 1440 [16 July 2019], which cannot be applied when applying the rules referred to in clause First of this decree, for a period not exceeding three years.

Third

His Royal Highness the Deputy Prime Minister, the ministers, and the heads of independent concerned authorities—each within their area of mandate—shall implement this decree of Ours.
