Council of Ministers: Decision 692 Approving the Railway Law

The Council of Ministers,

after perusal of its session held under the chairmanship of the Custodian of the Two Holy Mosques, King Salman bin Abdulaziz Al-Saud, regarding Royal Court Files 74576 dated 28 Dhu Al-Hijjah 1443 [28 June 2022] and 79040 dated 18 Dhu Al-Qa’dah 1443 [18 June 2022], which includes Minister of Transport and Logistics, Chairman of the Board of Directors of the Transport General Authority Letter 5052 dated 17 Dhu Al-Qa’dah 1441 [8 July 2020], regarding the draft Railway Law,

after perusal of the aforementioned draft law,

after perusal of the Railway Transport Law issued by Royal Decree D/33 dated 24 Jumada Al-Awwal 1433 [16 April 2012] and its amendment,

after perusal of the Bureau of Experts at the Council of MinistersMinutes 782 6 Rabi Al-Thani 1443 [12 November 2021] and Memorandums 1177 dated 22 Dhu Al-Hijjah 1441 [12 August 2020], 1605 dated 19 Rajab 1443 [21 February 2022], 1601 dated 26 Jumada Al-Awwal 1444 [20 December 2022], 3056 dated 13 Shawwal 1444 [25 May 2021], 3930 dated 23 Dhu Al-Hijjah 1444 [2 July 2023], 747 dated 2 Rabi Al-Awwal 1445 [17 September 2023], 1286 dated 16 Rabi Al-Thani 1445 [31 October 2023], and 2576 dated 17 Rajab 1445 [28 January 2024],

after perusal of the Council of Economic and Development Affairs Recommendation 1-7/45/R dated 29 Jumada Al-Awwal 1445 [8 December 2023],

after considering Shura Council Decision 279/43 dated 22 Dhu Al-Qa’dah 1443 [22 June 2022],

and after perusal of the General Committee of the Council of Ministers Recommendation 8071 dated 27 Rajab 1445 [7 February 2024],

hereby decides

First

The Railway Law is hereby approved in the form attached.

Second

The law—referred to in clause First of this decree—must upon its entry into force replace the Railway Transport Law issued by Royal Decree D/33 dated 24 Jumada Al-Awwal 1433 [16 April 2012] and repeal all provisions that contradict it.

A draft royal decree has been prepared in the form attached.

Third

The Ministry of Transport and Logistics Services shall, in accordance with the statutory procedures, develop the necessary strategies, policies and plans for the development of the railway sector, and supervise their implementation, in order to achieve integration with other transport sectors in the Kingdom, in coordination with the General Authority for Transport.

Fourth

The General Authority for Transport, in light of the provisions of the law referred to in clause First of this decision and in light of the transfer of supervisory, regulatory, and monitoring competences for the postal sector from the Ministry of Communications and Information Technology to the Ministry of Transport and Logistics Services, and after the issuance of two drafts: the Road Transport Law, and the Organization of the General Authority for Roads, to consider the occasion of amending its regulation or preparing a new regulation accordingly, and reporting to complete what is necessary in its regard.

Fifth

The General Authority for Transport shall exercise its powers mentioned in article 8 of the law referred to in clause First of this decision in agreement with the Ministry of Finance and the Non-Oil Revenue Development Center, until the issuance of the regulation on the practice of public authorities and institutions and the like imposing the financial remuneration for the services and works they provide.
